Terms of ordering and delivery of gifts

The website www.pravipoklon.com (hereinafter referred to as the Point of Sale) is owned by Sotex Inc, 300 Delaware Avenue, Suite 210-A, Wilmington De, 19801 in New Castle County, Delaware USA. (hereinafter referred to as the Seller).


Explanation of terms used in the text:

ORDER is the obligatory relationship of the Buyer (the person who ordered the goods and made or undertook to make the payment) and the Seller who undertook to deliver the sold goods to the consignee at the place and/or address specified by the Buyer.

VALID ORDER is when the buyer has made a payment or has undertaken to make a payment and when he has made available to the Seller all the necessary information to execute the delivery.

ORDERER (BUYER) is the person who ordered the goods from the Seller.

RECIPIENT is the person assigned by the ordering party to receive the goods.


Receiving an order

The Seller receives orders via the Point of Sale, by phone, or in writing via e-mail (directly written or sent via the online form located at the Point of Sale).

The Ordering Party is obliged to provide the Seller with all relevant information necessary for successful and uninterrupted delivery, which refers to the name and surname of the recipient, the exact address to which the delivery is made, the contact phone number of the recipient, and other important information.


Deadlines and Delivery times

The seller will deliver the ordered goods to the requested address at the request of the buyer, taking into account that the desired delivery time is met.

The seller reserves the right to adjust the hour and minute of delivery to its capabilities, but not more than 60 minutes before and 60 minutes after the requested delivery time.


Delivery

The seller will deliver the ordered gift to the recipient's address.

Naručilac može biti i primalac, ako naručuje poklon za sebe. Osim primaoca poklon može preuzeti i bilo koja druga osoba na adresi primaoca ukoliko to želi učiniti.

The orderer can also be the recipient, if he orders gift for himself. Apart from the recipient, gift can be picked up by any other person at the recipient's address if they wish to do so.

The seller will inform the customer about the delivery (with SMS, e-mail or, phone).

The customer is obliged to be available by phone at the time specified for delivery so that he can get in touch in case of possible problems during delivery.

Delivery to hospitals, hotels, and offices:  

Additional information will be required for delivery to the noted institutions: the exact name of the institution, address, telephone, room number, floor, etc.

Delivery to such places is also considered completed when the ordered arrangement is received by the person in charge of receiving such shipments.


Execution of delivery

Delivery shall be deemed to have been effected when the consignee or a competent person at the consignee's address signs the delivery note.

The seller will make every effort to make the delivery, but in the four cases listed below, even though the delivery is not committed, it considered committed:

In the first three cases, we will inform the orderer about the situation. The customer will, if he wishes, be able to pick up the product at his own expense in the partner florist within 36 hours from the moment we inform him. If in this situation we cannot get in touch with the orderer within the deadline of 30 minutes, we will consider the delivery complete.


Complaints

Complaints about the delivered gift will be accepted by the Seller if it is reported within 1 hour after delivery.

Complaints will be accepted in the event that the Seller did not comply with any agreed part of the order, if the wrong gift basket was delivered or the delivery was made to the wrong person or to the wrong address.

The seller undertakes to correct listed omissions in the shortest possible time


Order cancellation

Due to possible abuse, it is not possible to cancel the order.


Products (flowers and plant material)

Due to the seasonal characteristics and nature of the plant material, the Seller cannot guarantee that the appearance of the product will be the same in everty details as on the corresponding image. The seller will always strive for the built-in elements to be identical to the photo of the ordered arrangement, but in the interest of the customer, the seller reserves the right to replace one or more components in the product, but always so that the product still matches the description and quality.


Warnings and situations in which the Seller does not take responsibility for the caused damage

The ordered should be aware that he is ordering a "live" product, so although the Seller guarantees that he will use the best quality plant material, the length of the "life" of the delivered products depends on the nature of the plant material and the care provided by the recipient.

Some types of flowers and leaves can be toxic or cause skin rashes. It is necessarily to keep these products out of the reach of children and people with sensitive skin, wash your hands after contact with flowers and leaves.

Pollen from the anthers of some flower species (such as lilies or anemones) can leave permanent stains on clothes. The recipient should take care that clothes and furniture do not come into contact with these types of flowers.

Never leave flowers near electrical appliances and always use some kind of protective material between the plant pots and the surface on which they stand.

Some arrangements include fruits, vegetables, candles, or other decorative items. No part of the arrangement is intended for eating. It is not recommended to light candles near flammable things and objects or to leave them lit unattended.


Statement on the protection and collection of personal data and their use

The seller undertakes to protect the privacy of all its users.

The collected data that is necessary for the quality provision of the service will be used exclusively for the purpose of realization of the received orders and will not be given for use to third parties.

All customer data is strictly kept and is available only to Seller employees who can use it solely for the purpose of providing service to the customer. All Seller employees and business partners are responsible for respecting the principles of privacy protection.

By using the Seller's services, you agree to the collection of personal data and their use for the stated purposes. If you do not want us to take your personal information or you do not agree with some part of this statement, please do not use the services of the Seller.

When ordering at the Point of Sale, telephone or, e-mail, it is assumed that the customer is familiar with the above conditions and fully agrees with them.
